Notice of Privacy Practices
This notice describes how medical information about you may be used and disclosed by Medically Modern DME, and how you can get access to this information. Please review it carefully.

Our commitment to your health information
Medically Modern DME, 161 Main Street, Mount Kisco, NY 10549, is required by the Health Insurance Portability and Accountability Act (HIPAA) to maintain the privacy of your protected health information (PHI), to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect.
This notice describes how we may use and disclose your health information and the rights you have regarding that information.
Permitted uses and disclosures
We may use and disclose your health information without your written authorization for the following purposes:
- Treatment: to coordinate the equipment and supplies your clinician has ordered, including sharing information with your prescribing clinician, treating physicians, home care agencies, and manufacturers involved in fitting or servicing your equipment.
- Payment: to verify eligibility and benefits, obtain prior authorization, submit claims, appeal determinations where permitted and authorized, and collect amounts owed by you or your plan.
- Health care operations: to support quality review, staff training, product recalls and safety notices, accreditation, licensing, audits, compliance activities, and business management.
- As required or permitted by law: including public health reporting, adverse event reporting to the FDA, health oversight activities, judicial and administrative proceedings, law enforcement requests, and workers' compensation.
Uses that require your authorization
Most uses and disclosures not described above require your written authorization, including any use of your information for marketing purposes or any sale of your health information. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.
Your individual rights and how to exercise them
You have the following rights regarding the health information we maintain about you. Submit any request in writing to our Privacy Officer at Medically Modern DME, 161 Main Street, Mount Kisco, NY 10549, or call the Privacy Officer at (347) 817-1037 for help putting a request in writing. We will respond within the timeframes HIPAA requires.
- Right of access: you may inspect and obtain a copy of your health information, including an electronic copy, and direct us to send a copy to a person you designate. We may charge a reasonable, cost-based fee.
- Right to request an amendment: if you believe information we hold is incorrect or incomplete, you may request an amendment. We may deny the request in limited circumstances and will explain the denial in writing and describe how you may respond.
- Right to an accounting of disclosures: you may request a list of certain disclosures we made of your health information, generally for the six years before your request.
- Right to request confidential communications: you may ask us to contact you at an alternate address or phone number, or to ship supplies in a manner that protects your privacy. We will accommodate reasonable requests.
- Right to request restrictions: you may ask us to limit how we use or disclose your information for treatment, payment, or health care operations. We are not required to agree to every request, but we must agree to a request to withhold information from your health plan when you pay for an item in full out of pocket.
- Right to a paper copy of this notice: you may request one at any time, even if you agreed to receive it electronically.
- Right to notice of a breach: you will be notified if a breach involving your unsecured health information occurs.
Complaints and no retaliation
If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer at Medically Modern DME, 161 Main Street, Mount Kisco, NY 10549, or by phone at (347) 817-1037. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington, DC 20201, by calling 1-877-696-6775, or online at hhs.gov/ocr/privacy/hipaa/complaints.
We will not retaliate against you, and you will not lose service or benefits, for filing a complaint or exercising any of the rights described in this notice.
Our legal duties
We are required by law to protect the privacy of your health information, to provide this notice, to abide by the terms of the notice currently in effect, and to notify you following a breach of unsecured protected health information.
We reserve the right to change this notice and to make the revised notice effective for health information we already hold as well as information we receive in the future. The current notice will always be available on this page, and a copy is posted at our Mount Kisco location.
